Maqāṣid and their Role in Deriving Shariah Rulings

The Council of the International Islamic Fiqh Academy of the Organization of the Islamic Conference, holding its 18th session in Putrajaya, Malaysia, on 24–29 Jumādā al-Ākhirah 1428h (9–14 July 2007),

Having examined the research papers submitted to the Academy concerning

Maqāṣid (Shariah Objectives) and their Role in deriving Shariah Rulings, Having listened to the discussions on the subject,

Resolves

First: The Objectives of Shariah refer to the abstracts, general wisdom, and final ends that Shariah-Giver seeks to achieve through stipulation of rulings that realize people’s interests in this world and the Hereafter.

Second: Due consideration to the objectives of Shariah in Ijtihād serves sev- eral purposes, including the following:

  1. Comprehensive view of the texts and rulings of
  2. Fulfilment of the objectives of Shariah is a weighing factor in compari- sons between different Fiqh
  3. Identification of the end results of the acts of individuals and subjecting them to the rulings of Shariah.

Third: Adopting the objectives of Shariah at their different levels as the pri- mary and most appropriate framework for human rights.

Fourth: Importance of recalling the objectives of Shariah in the derivation of Shariah rulings.

Fifth: Proper application of the objectives of Shariah does not counteract the implications of the Shariah texts and consensus-based rulings.

Sixth: The need for studying the various dimensions of the objectives of Shariah in the social, economic, educational, and political areas.

Seventh: Recalling the objectives of Shariah is quite essential for proper un- derstanding of the Islamic Discourse.

Eighth: Importance of applying the Objectives of Shariah for deriving ap-

propriate Shariah rulings for emerging issues and new kinds of contemporary financial transactions. This would help achieve excellence in Islamic financing modes and products, which should have their own distinctions from conven- tional modes and products.

Recommendations

  1. Calling upon the Secretariat of the academy to commission further re- search to elaborate on the meaning of the objectives of Shariah and pres- ent the Fiqh literature contributed on the subject.
  2. Calling upon academic institutions and centers to include the objectives of Shariah as a subject in their educational curricula.

Indeed, Allāh is All-Knowing.

Secretary‑General of the Academy Visits the Consulate General of the Hashemite Kingdom of Jordan His Excellency Professor Dr. Qutb Mustafa Sano, Secretary‑General of the Academy, paid an official visit on 29 Sha‘ban 1447 AH, corresponding to 17 February 2026, to the Consulate General of the Hashemite Kingdom of Jordan in Jeddah. His Excellency and his accompanying delegation were received by His Excellency Ambassador Mohammed Salah Sobhi Hameed, Consul General and Permanent Representative of Jordan to the Organization of Islamic Cooperation, who welcomed him warmly and expressed his pleasure at the visit. He praised the distinguished intellectual efforts undertaken by the Academy under His Excellency’s leadership in addressing numerous religious and intellectual issues of concern to the Islamic world, affirming his personal honor in meeting His Excellency again and Jordan’s keenness to strengthen channels of communication and cooperation with the Academy, especially in areas of mutual interest. For his part, His Excellency expressed his deep gratitude and great appreciation to the Ambassador for the warm reception and generous hospitality. He commended the tremendous support, gracious care, and continuous attention the Academy has received from the leadership and people of Jordan since its establishment. He also conveyed his sincere appreciation for the Ambassador’s recent visit to the Academy, affirming the Academy’s full readiness to do everything that would enhance partnership, cooperation, coordination, and communication between the Academy and Jordanian religious and academic institutions. His Excellency was accompanied by Mr. Mohammed Al‑Mundhir Rida Al‑Shawk, Director of the Office and Protocol; Mr. Mohammed Waleed Al‑Idrisi, Director of Media and Public Relations; Ms. Sarah Amjad Badawi, Director of the Department of Family, Women, Children, and the Elderly; and Mr. Amjad Ibrahim Al‑Mansi, Head of the Protocol Section.
